1. Installation & Use — Owner’s Risk
All ENG Custom aftermarket parts are supplied for installation at the owner’s risk.
Purchaser/installer accepts full responsibility for proper selection, installation, maintenance, and use of products. ENG Custom is not responsible for any damage, loss, or injury resulting from installation, removal, modification, misuse, or operation of the products.
2. Professional Installation Required
ENG Custom strongly recommends professional installation by an experienced automotive or composite technician. Improper installation (including but not limited to incorrect drilling, trimming, over-tightening fasteners, or improper mounting) can cause product failure, vehicle damage, or personal injury and will void any warranty related to the affected product.
3. Intended Use; Off-Road / Display Only Products

Exhaust systems, cat-backs, and similar performance components sold by ENG Custom are intended for off-road or competition use only unless explicitly labeled otherwise. It is the buyer’s responsibility to ensure the product is legal for use on public roads in their jurisdiction prior to installation.

Airbag covers and decorative interior pieces are for display and show purposes only and are not intended or approved for use with active airbag systems or on-road safety systems. Do not install or use airbag covers in any manner that interferes with the operation of an airbag. ENG Custom disclaims any liability for injuries, death, or damage resulting from use, misuse, or installation of airbag covers.
4. Compliance With Laws & Regulations
Buyer is solely responsible for determining compliance with local, state, provincial, and federal laws, regulations, and emissions rules. ENG Custom does not guarantee that any product complies with local laws or is legal for street/highway use. You must verify legal status and obtain any required certification, permits, or inspections before use on public roads.
5. No Implied Safety Certification or Crashworthiness
ENG Custom parts are not crash-tested by ENG Custom, and no product should be assumed to provide crash protection or safety performance equal to OEM parts. Any modification to a vehicle may affect its crashworthiness or safety systems. ENG Custom is not responsible for changes to vehicle safety, occupant protection, or handling caused by aftermarket parts.
6. Limitation of Liability
To the fullest extent permitted by law, ENG Custom’s liability for any claim arising from or related to its products (whether under contract, tort, warranty, strict liability, or otherwise) is limited to repair, replacement, or refund of the purchase price of the product at ENG Custom’s sole discretion. ENG Custom will not be liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of use, loss of profits, vehicle downtime, towing, rental, labor, or consequential economic loss.
7. Indemnification
By purchasing, installing, or using ENG Custom products, you agree to indemnify, defend, and hold harmless ENG Custom, its officers, employees, agents, distributors, and dealers from any and all claims, demands, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your installation, modification, use, or resale of ENG Custom products.
8. Warranty Limitations & Voiding Conditions
ENG Custom’s written warranty (if any) applies only to defects in materials or workmanship as expressly stated in the product warranty. The warranty is void if the product is:

Altered, cut, drilled, trimmed, or modified other than in accordance with ENG Custom instructions;

Installed by an unqualified person in a manner that causes damage;

Subject to misuse, collision, racing, competition use, or abusive conditions; or
-
Exposed to extreme heat, chemical exposure, or improper finishing procedures not recommended by ENG Custom.
9. Shipping, Inspection & Claims
Inspect all shipments upon delivery. Note any visible damage on the carrier’s delivery receipt and retain all packaging. Failure to follow ENG Custom’s shipping damage procedures may limit or void recovery from the carrier. See ENG Custom’s published shipping and claims policy for details.
10. Entire Agreement; Governing Law; Severability
This Disclaimer and any related written agreement constitute the entire agreement between you and ENG Custom concerning aftermarket parts and supersede any prior representations or agreements. This Disclaimer is governed by the laws of the state of Texas (without regard to choice-of-law principles). If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
11. No Reliance / Professional Advice
ENG Custom is not providing legal, safety, or compliance advice with respect to any particular use of its products. Customers should consult qualified professionals (installation technicians, certified mechanics, and licensed attorneys) for installation instructions, legal compliance, and safety guidance.
12. Acknowledgement
By purchasing, receiving, or installing ENG Custom products you acknowledge that you have read, understand, and agree to this Disclaimer and Liability Waiver.
